Premium Sporting – Comprehensive Terms and Conditions

General

Premium Sporting sells sporting goods, ammunition, firearms, firearm parts, optics, suppressors, NFA items, flamethrowers where lawful, and related accessories. Product descriptions, specifications, images, UPCs, pricing, inventory, and availability may change without notice. Premium Sporting reserves the right to refuse, limit, modify, hold, verify, or cancel any order for compliance, inventory, pricing, fraud, payment, regulatory, or business reasons.

Eligibility and Legal Capacity

By placing an order, you represent that you are legally eligible to purchase, possess, receive, and use the products ordered and have the legal capacity to enter into binding agreements.

Buyer Responsibility and Compliance

Customers are solely responsible for understanding and complying with all federal, state, and local laws governing possession, ownership, transfer, transportation, storage, use, import, export, and resale of products purchased from Premium Sporting.

Purchaser Responsibility for Legal Compliance

The purchaser bears sole and exclusive responsibility for determining whether any product purchased from Premium Sporting is lawful to purchase, receive, possess, own, transfer, transport, store, import, export, carry, modify, install, or use within their jurisdiction.

This responsibility includes compliance with all applicable laws, regulations, ordinances, restrictions, licensing requirements, registration requirements, permitting requirements, and administrative rules imposed by any governmental authority, including but not limited to:

  • Federal laws and regulations
  • State laws and regulations
  • County laws and ordinances
  • City and municipal laws and ordinances
  • Township and local government requirements
  • Tribal laws and regulations
  • Territorial laws and regulations
  • Homeowner association restrictions where applicable
  • Any other applicable governmental or regulatory authority

The purchaser acknowledges that laws and regulations may change without notice and may vary significantly between jurisdictions.

Premium Sporting does not provide legal advice and makes no representation, warranty, or guarantee that any product offered for sale is lawful in any particular jurisdiction.

Acceptance of an order, collection of payment, shipment of a product, provision of compliance information, or communication from Premium Sporting shall not be interpreted as a determination that a product is legal for the purchaser.

The purchaser assumes all responsibility and liability for ensuring compliance with all applicable laws and regulations before placing an order and before taking possession of any product purchased from Premium Sporting.

Export Compliance

Premium Sporting complies with applicable U.S. export laws including ITAR, EAR, OFAC, and related regulations. Customers are responsible for compliance with all export restrictions. Premium Sporting reserves the right to refuse or cancel orders that present export compliance concerns.

Orders, Pricing and Payment

All orders are subject to acceptance and verification. Pricing errors, inventory discrepancies, fraud concerns, and compliance concerns may result in cancellation.

Identity Verification and Fraud Prevention

Premium Sporting reserves the right to require government-issued identification, address verification, age verification, payment verification, selfie verification, proof of residency, or additional documentation before shipment. Failure to provide requested information may result in order cancellation.

Compliance Holds

Any order may be placed on hold for identity verification, payment verification, FFL verification, export review, fraud review, address verification, straw-purchase review, or legal review.

Order Cancellations

Canceled orders are subject to a 15% cancellation fee except where prohibited by law. Serialized firearms, suppressors, receivers, NFA items, and other serialized products are subject to an additional 10% Serialized Item Processing Fee. Total deductions may equal up to 25% of the purchase price.

FFL Transfers

Firearms and regulated items ship only to valid FFLs. Buyers are responsible for all transfer fees, waiting periods, storage fees, refusal fees, and background-check requirements.

FFL Selection

Purchasers are responsible for selecting a receiving FFL willing and able to complete the transfer. Costs arising from an FFL’s refusal, delay, non-response, or inability to transfer remain the purchaser’s responsibility.

No Shipments to Type 03 (C&R) Licensees

Premium Sporting does not sell, ship, or transfer firearms to holders of a Type 03 Collector of Curios and Relics (C&R) Federal Firearms License, including firearms that qualify as curios or relics. A Type 03 license will not be accepted as the receiving FFL on any order. All firearm orders must ship to a Type 01, 02, or 07 dealer FFL, where the purchaser completes ATF Form 4473 and any required background check. Orders that list a Type 03 license as the receiving FFL will be held until a qualifying dealer FFL is provided and may be canceled subject to the cancellation terms in these Terms and Conditions.

Failed Background Checks

Orders canceled due to denial, delay, prohibited-person status, transfer refusal, or failure to complete transfer requirements may be subject to cancellation fees, processing fees, return shipping charges, and direct costs.

Abandoned Transfers

Products remaining unclaimed at an FFL for more than 30 days after notice may be deemed abandoned and returned at the purchaser’s expense.

NFA Items

ATF approvals, Form 1, Form 3, Form 4 processing, tax stamps, transfer approvals, and timelines are solely the responsibility of the purchaser and ATF. Premium Sporting does not guarantee approval or processing times.

Suppressor Processing

Estimated ATF wait times are informational only and not guaranteed.

Age Restrictions

You must meet all applicable age requirements.

Magazine Capacity and Restricted Products

Customers are responsible for ensuring magazines, accessories, parts, suppressors, NFA items, and related products are legal in their jurisdiction.

Product Descriptions

Photographs, specifications, descriptions, compatibility information, and manufacturer data may contain errors and are provided for convenience only.

Warranty Disclaimer

Products are sold AS IS and AS AVAILABLE except for warranties provided by the manufacturer.

Defective Products

Premium Sporting does not determine whether products are defective. Warranty claims, repairs, replacements, refunds, and exchanges are governed solely by manufacturer policies. Premium Sporting will only facilitate remedies approved by the manufacturer except where required by law.

Return Authorization

All returns require prior authorization. Unauthorized returns may be refused and returned to the sender.

Refund Policy

Eligible non-serialized returns must be initiated within 90 days and may be subject to a 15% restocking fee. Ammunition sales are final except where required by law or due to verified shipping error.

Serialized Items

Serialized firearms, suppressors, receivers, NFA items, and other serialized products are non-returnable once transferred by the receiving FFL.

New Jersey Ammunition Compliance

Customers purchasing ammunition for shipment to New Jersey must provide a government-issued photo ID, a valid New Jersey Firearms Purchaser Identification Card (FPIC/FID), and any additional permits, licenses, certifications, or documentation required by applicable law. Documentation must accompany the order or be provided upon request. Premium Sporting may request additional documentation and may hold, delay, refuse, or cancel orders if documentation is incomplete, unverifiable, or not received. Customers certify compliance with all applicable federal, state, and local laws.

Restricted Jurisdictions, State Compliance, and Product Eligibility

Premium Sporting sells products nationwide where lawful; however, numerous states, territories, counties, municipalities, and local jurisdictions impose restrictions, prohibitions, licensing requirements, registration requirements, waiting periods, documentation requirements, magazine-capacity limits, product-configuration restrictions, ammunition restrictions, transfer requirements, or other regulations affecting the purchase, possession, transfer, transportation, storage, importation, exportation, and use of certain products.

Products potentially subject to restrictions include, but are not limited to:

  • Firearms
  • Handguns
  • Rifles
  • Shotguns
  • Semi-automatic firearms
  • Receivers and frames
  • Ammunition
  • Magazines
  • Suppressors and silencers
  • Short-barreled rifles (SBRs)
  • Short-barreled shotguns (SBSs)
  • Machine guns
  • Destructive devices
  • NFA-regulated items
  • Binary triggers
  • Forced-reset triggers
  • Stabilizing braces
  • Threaded barrels
  • Muzzle devices
  • Firearm parts and components
  • Body armor
  • Night vision devices
  • Thermal optics
  • Flamethrowers
  • Ignition devices
  • Knives and edged tools
  • Any other regulated or restricted product

Certain jurisdictions, including but not limited to California, Colorado, Connecticut, Delaware, the District of Columbia, Hawaii, Illinois, Maryland, Massachusetts, New Jersey, New Mexico, New York, Oregon, Rhode Island, Vermont, Washington, U.S. territories, and local municipalities may impose restrictions beyond federal requirements.

Premium Sporting reserves the right to require additional documentation, permits, licenses, affidavits, certifications, acknowledgments, eligibility verification, age verification, residency verification, firearm identification cards, FOID cards, FPIC cards, concealed carry permits, government-issued identification, tax stamps, FFL information, or any other documentation deemed necessary to verify compliance with applicable laws.

Premium Sporting reserves the right, at its sole discretion, to refuse, hold, delay, modify, limit, investigate, or cancel any order if:

  • Product legality cannot be verified;
  • Documentation is incomplete, inconsistent, inaccurate, unverifiable, or not provided upon request;
  • Shipment may violate federal, state, local, territorial, or international laws;
  • Distributor, manufacturer, carrier, payment processor, insurer, or compliance requirements prohibit shipment;
  • Fraud, straw-purchase concerns, export-control concerns, or other compliance concerns exist; or
  • Premium Sporting determines that completing the transaction presents legal, regulatory, financial, operational, or reputational risk.

The purchaser remains solely responsible for determining whether a product is lawful to purchase, possess, receive, transfer, transport, store, import, export, or use within their jurisdiction.

Acceptance of an order, collection of payment, shipment of a product, provision of documentation guidance, or communication from Premium Sporting shall not constitute legal advice or a representation, warranty, or guarantee that any product is lawful in any particular jurisdiction.

Premium Sporting may modify, update, expand, restrict, or discontinue shipments to any jurisdiction at any time without notice to reflect changes in applicable laws, regulations, manufacturer requirements, distributor requirements, carrier policies, insurance requirements, compliance obligations, or business policies.

Flamethrowers and Ignition Devices

Flamethrowers and similar products are sold only where lawful. Purchasers are solely responsible for legality, permits, burn bans, fire-code compliance, transportation restrictions, and local ordinances.

Lost or Stolen Packages

Risk of loss transfers upon carrier-confirmed delivery. Premium Sporting is not responsible for theft, loss, or damage after delivery confirmation.

Carrier Delays

Delivery dates are estimates only. Premium Sporting is not responsible for delays caused by carriers, weather, labor actions, customs, government actions, or events beyond its control.

State and Local Restrictions

Premium Sporting reserves the right to refuse or cancel orders where legality cannot be confirmed.

Straw Purchases

Orders suspected of involving straw purchases, prohibited persons, fraud, export violations, or unlawful conduct may be canceled and reported when required by law.

Chargebacks

Customers agree to contact Premium Sporting before initiating a chargeback. Premium Sporting reserves the right to contest chargebacks and recover associated costs.

No Legal Advice

Information provided by Premium Sporting is informational only and does not constitute legal advice.

Taxes

Customers are responsible for all applicable taxes, duties, customs fees, and governmental charges.

Arbitration and Governing Law

Disputes shall be resolved through binding individual arbitration to the fullest extent permitted by law.

Indemnification

Customers agree to indemnify and hold harmless Premium Sporting from claims, damages, losses, liabilities, penalties, fines, costs, and expenses arising from possession, use, transfer, export, transportation, storage, or resale of products.

Policy Changes

Premium Sporting reserves the right to modify these Terms and Conditions at any time. The version in effect at the time of purchase governs the transaction unless otherwise required by law.

Checkout Agreement

By placing an order, you acknowledge that you have read and agree to these Terms and Conditions and accept sole responsibility for compliance with applicable laws.
